Welcome to EduGoal! These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” or “User”) and EduGoal Global Services LLC (“EduGoal,” “we,” “our,” or “us”). These Terms govern your access and use of our learning management system (LMS),  mobile applications (EduGoal Global Apps), and web applications (edugoaleducation.com), and any additional services we provide (collectively, the “Services”).

By creating an account, accessing, or using EduGoal Global Services, you agree to be bound by these Terms. If you do not agree, you cannot use our Services.

1. Who Can Use EduGoal Global Services

• You must be an active administrator or teacher or student in a participating school district and/or school.  
• By using EduGoal on behalf of an organization (e.g., a school or training provider), you confirm you have the authority to bind that organization to these Terms.

2. Accounts and Responsibilities

• You are responsible for providing accurate registration information and keeping your login credentials secure.
• You are accountable for all activity that happens under your account.
• If you suspect unauthorized access, notify us immediately.

3. Services and Plans

EduGoal offers:

• Free Plans – limited features for individuals and schools.
• Paid Plans – enhanced features, integrations, and customization options, billed on a subscription basis to individuals, schools, and school districts.

Some features may use third-party services. We are not responsible for the availability or performance of these external providers.

4. Payments and Renewals

• Paid subscriptions are billed in advance on an annual or monthly basis.
• By subscribing, you authorize us to charge your chosen payment method automatically unless you cancel at least 60 days before renewal.
• Late or failed payments may result in suspension or termination of access.

5. Data and Privacy

• You retain ownership of the content and personal data you upload (“User Data”).
• By using EduGoal, you grant us a limited license to process, store, and back up your data solely to provide the Services.
• We implement industry-standard security measures but cannot guarantee absolute protection against data loss or breaches.
• Our use of personal information is governed by the EduGoal Privacy Policy, which incorporates obligations under Gramm-Leach-Bliley Act (GLBA), General Data Protection Regulation (GDPR), Children's Online Privacy Protection Act (COPPA), Family Educational Rights and Privacy Act (FERPA), and other applicable data protection laws.

6. Your Rights as Users

As a User, you have the right to:

• Access, correct, or request deletion of your personal data.
• Withdraw consent for optional features at any time.
• Be informed if your data is shared with third parties for integrations or compliance purposes.
• Transparency when automated tools (such as analytics or adaptive learning features) impact your learning experience.
• Non-discrimination for exercising your privacy rights.

7. Acceptable Use

You agree not to:

• Copy, modify, or redistribute EduGoal’s software or content except as permitted.
• Upload unlawful, offensive, or harmful content.
• Attempt to bypass security features or access areas you are not authorized to use.
• Infringe on intellectual property rights of EduGoal or third parties.
• Use EduGoal Services for fraudulent, abusive, or harmful purposes.

Violation of this policy may result in suspension or termination of your account.

8. Intellectual Property

• EduGoal retains ownership of all platform software, designs, trademarks, and related intellectual property.
• Your rights are limited to educational or organizational use in line with these Terms.
• You own and are responsible for all content and learning materials you upload.

9. Service Availability and Support

• We strive to provide 24/7 access but may occasionally suspend services for maintenance or unforeseen disruptions.
• Standard support is available via email or help desk during business hours. Paid plan users may receive priority support.

10. Termination and Cancellation

• For users of the free plan, you may cancel your account at any time via your EduGoal portal.
• For users with the paid plan, a cancellation notice must be submitted via your user account at least 60 days before your contract ends. 
• We may suspend or terminate accounts for violations of these Terms, non-payment, or security risks.
• Upon termination, it is your responsibility to back up your data before access is closed.

11. Limitation of Liability

• EduGoal provides its Services “as is” without warranties of uninterrupted operation or error-free performance.
• To the maximum extent permitted by law, EduGoal is not liable for indirect, incidental, or consequential damages.
• Our total liability for claims relating to the Services will not exceed the fees paid by you in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold EduGoal harmless against claims, damages, or expenses arising from your misuse of the Services, violation of these Terms, or infringement of intellectual property rights.

13. Governing Law

These Terms are governed by the laws of the State of Delaware USA. Disputes will be subject to the exclusive jurisdiction of Delaware courts.

14. Updates to Terms

We may revise these Terms from time to time. Updates will be effective upon posting, and continued use of EduGoal means you accept the updated Terms.
